Terms of use:

1. HarverX
1.1 HarverX, patent pending, is Service from the company Harver B.V (Harver) provided to Harver Customers. When referring to the ‘Agreement’, the Harver Service Terms, DPA, SLA and relevant Order Form as concluded between Harver and Customer is meant.
1.2 HarverX is a Google Chrome Extension which ‘connects' an Applicant Tracking System (ATS) to the Harver (SaaS) Platform without an (API) integration. HarverX enables Customers to view applicant data from the Harver Platform while being on their own ATS. However, it’s important to note that there is no actual data integration; the data from the Harver Platform is only displayed on the ATS-page through HarverX.

2. General access
2.1 The extension can only be accessed if you have a valid Customer account for the Harver Platform (i.e. recruiters, admins).
2.2 The applicable Service Terms and/or Agreement between Harver and the Customer will be applicable to HarverX.
2.3 HarverX will only function on verified ATS pages, currently the following ATS pages are verified:
- Greenhouse
- PeopleXS
- UltiPro
- Taleo
- WebQube
2.4 HarverX verifies the ATS URL and verifies whether the Customer is on a supported page.
2.5 HarverX does not warrant that HarverX will function on any non-verified ATS page.
2.6 Customer can request their ATS to be verified by Harver, by contacting Harver Support.
2.7 Customer will have the same account access as on the Harver Platform, if certain Customer accounts are not allowed to see applicants from certain vacancies, this is also not possible on HarverX.

3. Account
HarverX is accessible through an account. To protect account information, Harver B.V. takes precautions and follows best practices to make sure the information is not inappropriately disclosed, lost, misused, altered, accessed or destroyed.
The account we provide Customer with exists out of use name, identification number, account code and/or password. This information is confidential and secret and should not be disclosed to any third party who is not authorized to enter HarverX.
Harver B.V. is not liable for any unauthorized access due to disclosure of your account information to any third party. Customer is solely responsible for any unlawful consequences that may occur.

4. Data
4.1 All data that is processed by the servers of Harver in respect of HarverX is safe and secure.
4.2 Upon the request of a Customer, HarverX will verify the email address of an applicant, but only if on a supported ATS. HarverX will never verify any random email addresses.
4.3 Applicants email addresses are never stored, they are solely used to match.
4.4 Applicant data is only shown in HarverX, it is never stored.
4.5 Harver can gather anonymous Customer behaviour data (only in the extension itself) through Google Analytics, this does not concern any personal data.

5. Support
5.1 The only supported browser for HarverX is currently Google Chrome.
5.2 We offer dedicated support for HarverX.

6. Liability
Liability arrangements will be in accordance with the agreed upon provisions under the Agreement.

7. Intellectual Property
7.1 Harver B.V. is exclusive owner of all the database rights, brands, copyright, intellectual property rights, trademarks, patent, content including text, graphics, photographs, still and moving images, audio, illustrations and software and all the other elements and materials displayed on Harver X. All the elements on the Harver X platform are protected by copyright, trademark, patent and/or other laws in relation to the intellectual property laws.
7.2 Harver B.V. reserves all rights not expressly granted in the Agreement. Customer acknowledges and agrees that Harver and/or its licensors retain all Intellectual Property Rights related to Harver X and any other work products delivered to Customer, whether or not as additional Services. The provision of the Service or any related product or service does not imply any transfer of Intellectual Property Rights to Customer. Customer acquires limited rights of use only in as far as explicitly granted under the Agreement.
7.3 Customer is not entitled, without Harver’s prior written consent, to modify, delete or make additions to Harver X, including the trademarks and other Intellectual Property Rights incorporated therein. Customer shall refrain from any act that infringes the Intellectual Property Rights of Harver, including – but not limited to – the registration of domain names, trademarks or Google Adwords that are identical or similar to any object to which Harver holds Intellectual Property Rights, as well as the reproduction, modification, reverse engineering or publishing of HarverX, nor is Customer entitled to apply reverse engineering to Harver X, unless to the extent permitted by law.

8. Choice of Law & Legal venue
The choice of Law and Legal venue as agreed upon by Customer and Harver in the Agreement will govern any disputes that may arise regarding the use of HarverX.
